Haventree Bank "2023 Renew and Win" (the "Contest") - Official Rules and Regulations ("Rules")
1. Contest Period and Sponsor
The Contest will run from April 1, 2023, 12:01 a.m. Eastern Time ("ET") to July 31, 2023 at 11:59 p.m. ET (the "Contest Period") after which time the Contest will be closed and no further entries will be accepted. The Contest sponsor is Haventree Bank 100 King Street West, Toronto, Ontario (the "Sponsor").
2. Eligibility
The Contest is open to individuals who are existing Haventree Bank mortgagors in good standing who have, during the Contest Period renewed for either a one, two, three or five year term mortgage with Haventree Bank and who are legal residents of Canada (excluding Quebec) who have reached the age of majority in their province or territory of residence at the time of entry, with the exception of: employees of the Sponsor, Haventree Holdings Inc., and their respective related and affiliated companies, subsidiaries, agencies, service providers, contractors, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development, production, distribution and execution of the Contest and those living in the same household. Government agencies are not connected with this Contest and are not liable in any way whatsoever in regard to any matter that relates to this Contest. Mortgagors that do not have an existing mortgage with Haventree Bank and mortgagors who have a mortgage with Haventree Bank but which is not up for renewal during the Contest Period are not eligible to participate in the Contest.
3. How to Enter
NO PURCHASE IS REQUIRED. To enter, confirm with Haventree Bank that you wish to enter the draw. Haventree Bank will send you an email through which you may register for the draw. Once you successfully complete and submit your contest registration, provided that you meet the Contest eligibility criteria in these Rules you will earn one entry for each one (1) or two (2) or three (3) or five (5) year term Haventree Bank non-prime mortgage you have renewed with Haventree Bank during the Contest Period. Receipt of an online entry occurs when Sponsor's server records all of the entry information. All entries must be complete and are subject to verification by the Sponsor, in its sole discretion. Limit of one entry eligible mortgage renewal. If you meet the eligibility criteria and do not have access to email you may enter by completing and submitting a hand drawn facsimile of the entry form and sending it to: 2023 Renew and Win Contest, Haventree Bank, at 150 9th Ave SW. 17th Floor, Calgary, Alberta, T2P 3H9. Entries received after the end of the Contest Period will not be accepted.
Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Contest, or any other methods not authorized by these Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a Prize (defined below). Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Rules are void. Entrants grant Sponsor a non-exclusive licence to use all entries for any purpose. No correspondence will be entered into except with selected entrants. Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an entry.
By entering the Contest: (i) you represent and warrant that you are eligible to participate in the Contest; (ii) you represent and warrant that you have read and understood these Rules in their entirety; and (iii) you agree to be bound by the Rules and the decisions of the Sponsor, which are final and binding on all matters pertaining to the Contest. Entrants who do not comply with any of the Rules are subject to disqualification by the Sponsor, in Sponsor’s sole discretion.
4. Contest Prizes
There are a total of two (2) prizes ("Prize") available to be won. Each Prize is a mortgage payment (including principal and interest) of $2,500 in Canadian dollars. The payment will be made on the winner’s mortgage by the Sponsor in the calendar month following the awarding of the Prize. If the winner’s mortgage payment is less than $2,500 CAN, the remaining balance will be applied to the winner’s following mortgage payment due until the full $2,500 CAN amount is applied. In the event the winner’s mortgage payment is more than $2,500 CAN the winner will be responsible to pay the outstanding balance of the mortgage payment after deduction of the Prize value. Each Prize can only be applied to an eligible Haventree mortgage that has not been paid in full by the mortgagor. Prizes are not transferable, must be accepted as awarded and have no cash value. No more than one prize may be applied to an eligible Haventree mortgage.
All entrants assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or the use or redemption of a Prize. Prizes or any portion of a Prize cannot be combined with other discounts, promotions or special offers. Sponsor reserves the right to substitute an alternate Prize of equal or greater value if an advertised Prize is unavailable at the time of award.
5. Odds of Winning
The odds of winning a Prize are dependent on the number of eligible entries received from the beginning of the Contest Period until the last day of the Contest Period.
6. Draws and Winner Selection
The Sponsor will randomly draw two (2) eligible entries from the eligible entries received between the beginning of the Contest Period and the end of the Contest Period. The draw will take place at the Sponsor’s offices at 150 9th Ave SW. 17th Floor, Calgary, Alberta, T2P 3H9 on August 9, 2023.
The selected potential winning entrants will be contacted by phone or email at the Sponsor's sole discretion. Only the selected entrants will be notified. As a condition of winning a Prize, each selected entrant must: (i) first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question within the time limit specified by the Sponsor (which will be administered by phone or email by the Sponsor); and (ii) sign and return to the Sponsor the Release and Indemnity form described below no later than August 31, 2023, failing which the selected entrant will be disqualified.
If an eligible entrant is selected but: (i) cannot be reached after three (3) attempts by the Sponsor or any notification sent to the entrant is returned to the Sponsor as undeliverable; (ii) does not respond to the Sponsor’s contact attempts within the time specified by the Sponsor for a response; (iii) does not correctly answer, unaided, the mathematical skill-testing question within the time limit specified by the Sponsor; (iv) does not provide proof of identity to the Sponsor; (v) does not or cannot accept the Prize as awarded; (vi) does not sign and return to Sponsor the Release and Indemnity form on or before the specified deadline; or (vii) does not otherwise meet the eligibility criteria or comply with these Rules, the selected entrant will be disqualified and will not receive a Prize and another entrant will be selected by the Sponsor as a potential Winner (defined below) by way of a random draw from the remaining eligible entries, in the Sponsor’s sole discretion.
Only when a selected entrant has complied with all the above requirements will he/she be declared an official winner (a "Winner").
Award of Prizes will be coordinated directly by the Sponsor with each Winner within 10 days of them being declared a Winner. Any further costs and expenses not specifically described as included in the Prize (including, but not limited to claiming and using the Prize) are the responsibility of the Winner.
Sponsor is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for the Sponsor to receive a selected entrant’s response and Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
7. Release and Indemnity
All Winners must sign the Sponsor’s release and indemnity form ("Release and Indemnity") within the time stipulated by the Sponsor, stating that he/she has read and understood these Rules, and to: (i) confirm the Winner’s compliance with all Rules; (ii) agree to accept the Prize as awarded to the Winner; (iii) grant all consents and authorization for the Sponsor to use the Winner’s entry, name, city of residence, photograph, likeness, social media handle(s) and comments whether on videotape, photograph or any other means now or hereafter invented, in connection with any promotion or publicity at no additional compensation to the Winner, beyond the awarding of the Prize; and (iv) release, discharge and hold harmless Sponsor, Haventree Holdings Inc., and their respective related and affiliated companies, subsidiaries, agencies, service providers, contractors, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development, production, distribution and execution of the Contest and those living in the same household ("Released Parties") from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of entries by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a Winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of prizes as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by entrants with any of the Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a Prize, and the use of entries by the Sponsor.
8. Limitations of Liability
The Sponsor will not be liable for: (i) any incomplete, incorrect or inaccurate capture of information, whether caused by the Released Parties, Haventree Bank mortgage brokers or mortgage agents or other eligible Haventree Bank mortgagors, or by any equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; (ii) the theft, destruction or unauthorized access to, or alteration of, entries; (iii) technical failures of any kind, including, but not limited to any problems with, or technical malfunctions of, telephone networks or lines, computer online systems, servers or providers, computer equipment, software, viruses or bugs; (iv) any failure of any email to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or at any web site or combination thereof, interrupted or unavailable networks; (v) damage to a participant's or other person's system occasioned by, related to or resulting from participating in the Contest or downloading of materials in this Contest; (vi) late, delayed, damaged, misdirected, destroyed, lost, illegible, mutilated incomplete, incorrect, fraudulent, or stolen entries (which will be deemed void) or Release and Indemnity forms; (vii) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise; or (viii) late, lost, misdirected or unsuccessful efforts to notify a potential Winner.
9. Miscellaneous
The Prizes must be accepted as awarded and no transfer or substitution of the Prize will be permitted except as expressly provided in these Rules or at the Sponsor's sole discretion. The Sponsor reserves the right to substitute any Prize with a Prize of equal or greater value if for any reason the Prize cannot be awarded as contemplated in these Rules. Prizes are not convertible to cash. Proof of sending an entry will not be deemed proof of receipt.
All entries become the property of Sponsor. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way or do not otherwise comply with these Rules.
Sponsor reserves the right in its sole and absolute discretion to cancel, withdraw, amend, terminate or suspend this Contest in whole or in part at any time without prior notice or obligation for any reason, including if a virus, bug or other cause beyond the reasonable control of Sponsor corrupts the security, fairness or proper administration of the Contest. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, the Sponsor reserves the right to cancel the Contest and conduct a random draw from all previously received eligible entries received by the end of the Contest period.
A list of Winners may be obtained by sending a self-addressed stamped envelope to Haventree Bank Marketing Department, 100 King Street West, Suite 4610, Toronto, Ontario M5X 1E5, within 120 days after the end of the Contest Period.
The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of the province of Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in the city of Toronto, Ontario.
By entering this Contest, all entrants consent to the collection, use and disclosure of their personal information by Sponsor for the purposes of running the Contest , verifying entrant identity, awarding Prizes or for any other purpose indicated on the Contest website or to which entrants consent. Personal information will be otherwise collected, used, disclosed and stored by the Sponsor in accordance with its Privacy Policy. Once submitted, entries become the exclusive property of the Sponsor and will not be returned.
All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights reserved. Unauthorized copying or use of any of the Sponsor’s intellectual property without the express written consent of the Sponsor is strictly prohibited.
